Overview

Fyxes App ("Fyxes", "we", "our", "us") is a registered business name operated as a sole trader in Australia (ABN 71 229 858 126). We operate an online marketplace that connects customers ("Consumers") with independent cleaning service providers ("Cleaners") in Melbourne, Australia.

These Terms of Service ("Terms") govern your access to and use of the Fyxes website at fyxes.app and any related pages, content, and services (together, the "Website"). By accessing or using the Website, you agree to be bound by these Terms. If you do not agree, please do not use the Website.

Booking a clean, using the Fyxes mobile app, or providing cleaning services through Fyxes is governed by the in-app Consumer Agreement and Cleaner Agreement, which you accept during onboarding. Those agreements apply in addition to these Terms.

1. Who we are

Fyxes is a technology platform. We are not a cleaning company and we do not employ Cleaners. Cleaners who use Fyxes are independent contractors responsible for their own work, ABN, insurance, tax, and compliance obligations. Fyxes facilitates bookings, payments, and communication between Consumers and Cleaners — the cleaning service itself is provided by the Cleaner directly.

2. Using the Website

2.1 Eligibility

You must be at least 18 years old and able to enter into a legally binding contract under Australian law to use the Website. By using the Website, you confirm that you meet these requirements.

2.2 Acceptable use

You agree not to:

  • Use the Website for any unlawful, fraudulent, or harmful purpose
  • Copy, scrape, reverse-engineer, or republish any part of the Website without our written permission
  • Upload viruses, malicious code, or attempt to interfere with the Website's security or operation
  • Impersonate another person or misrepresent your affiliation with any person or organisation
  • Use the Website to send unsolicited marketing or spam
  • Attempt to gain unauthorised access to any account, system, or data

We may suspend or restrict your access to the Website if we reasonably believe you have breached these Terms.

2.3 Accounts

Creating an account on Fyxes (through the Website or the Fyxes mobile app) requires accurate and current information. You are responsible for keeping your account credentials secure and for all activity that happens under your account. Notify us immediately if you suspect any unauthorised use.

3. Website content and intellectual property

All content on the Website — including the Fyxes name, logo, design, text, graphics, images, and code — is owned by Fyxes or our licensors and is protected by Australian and international copyright, trademark, and other intellectual property laws. You may view and share Website content for personal, non-commercial purposes, but you must not reproduce, modify, or distribute it without our written permission.

"Fyxes" and the Fyxes logomark are trademarks of Fyxes App. You may not use them without our prior written consent.

4. Bookings, pricing, and payments

The Website may display pricing, service areas, and booking information. This information is provided as a guide only. Actual bookings, confirmed pricing, and payment are handled through the Fyxes mobile app, and are governed by the in-app Consumer Agreement and our Cancellation & Refund Policy.

Payments are processed by Stripe and Stripe Connect. Fyxes does not store full card details. Payouts to Cleaners are handled according to the Cleaner Agreement.

5. Third-party links

The Website may link to third-party websites or services (such as Stripe, Google Maps, or our social media pages). These are provided for convenience only. Fyxes does not control and is not responsible for the content, privacy practices, or availability of any third-party service.

6. Disclaimers

The Website is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Fyxes does not warrant that the Website will be uninterrupted, error-free, secure, or free from viruses or other harmful code. We do not guarantee the accuracy, completeness, or timeliness of any information on the Website.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot be lawfully excluded.

7. Limitation of liability

To the maximum extent permitted by law, Fyxes is not liable for any indirect, incidental, special, consequential, or punitive loss or damage, or loss of profits, revenue, data, goodwill, or business opportunity, arising out of or in connection with your use of the Website.

Where our liability cannot be excluded but can be limited, our liability is limited, at our option, to re-supplying the relevant service, or paying the cost of re-supply.

Fyxes is a marketplace platform. We are not responsible for the acts, omissions, or conduct of Cleaners or Consumers. The cleaning service is provided by the Cleaner directly.

8. Indemnity

You agree to indemnify and hold Fyxes harmless from any claim, loss, liability, or expense (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Website, or your violation of any law or the rights of any third party.

9. Privacy

Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which forms part of these Terms.

10. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you by email or through the app. Your continued use of the Website after an update means you accept the revised Terms.

11. Termination

We may suspend or terminate your access to the Website at any time, without notice, if we reasonably believe you have breached these Terms or if required by law. You may stop using the Website at any time.

12. Governing law

These Terms are governed by the laws of Victoria, Australia. You and Fyxes submit to the non-exclusive jurisdiction of the courts of Victoria and the Commonwealth of Australia in relation to any dispute arising out of or in connection with these Terms or the Website.
